Let’s say you get papers in the mail saying you’re being sued for a debt. Maybe it’s an old credit card. Maybe it’s something you’ve never even heard of. Your first instinct might be to ignore it and hope it goes away. That instinct will wreck you.
If you don’t respond or don’t show up to court, the judge makes a decision without you. And that decision almost always goes to the person who sued you. It’s called a default judgment, and the FTC is pretty clear about it: the debt collector can win simply because you didn’t appear. Not because they proved anything. Just because you weren’t there.
Here’s what makes this really frustrating. There are legitimate defenses that could get a case thrown out entirely — but only if you show up and actually use them. One big one is the statute of limitations. Every debt has a time limit on how long someone can legally sue you over it. After that window closes, it’s called a “time-barred debt” and in most cases it can’t be enforced in court. But that defense disappears if you never show up to raise it.
Same thing goes for debts that aren’t even yours. Debt collectors sometimes sue the wrong person. Or they buy old debt from other companies and don’t have solid proof it belongs to you. In many cases, courts put the burden of proof on the creditor — they have to show you actually owe the money. But rules vary by state, and that protection only matters if you show up and make them prove it.
And don’t think you can dodge this by refusing to accept the lawsuit papers. That doesn’t pause the clock or make the case go away. The FTC explicitly says the case can move forward even if you try to avoid being served. The legal system doesn’t need your cooperation to rule against you.
So what should you actually do? Read every paper you receive carefully. The CFPB says to respond by the deadline listed in the court documents — either yourself or through a lawyer. Even a basic written response saying you dispute the debt can change everything. It forces the creditor to actually prove their case instead of just collecting a free win.
